Rewards Terms

SuperSonic Rewards is a shared loyalty technology platform and consumer application operated by MSYM Investments, LLC d/b/a SuperSonic POS ("SuperSonic," "we," "us," or "our"). Independent participating merchants use the platform to offer and administer their own store loyalty programs (each, a "Store Program").
Your SuperSonic Rewards account allows you to access Store Programs offered by participating merchants. The points, rewards, earning rules, redemption rules, eligible purchases, expiration rules, and participating locations for each Store Program are selected by the merchant sponsoring that Store Program, not by SuperSonic. Store Programs are not one universal pool of points.
These SuperSonic Rewards Terms (the "Terms") govern your use of the SuperSonic Rewards platform, application, and account. Additional program-specific terms presented by a participating merchant through the application, at enrollment, at the point of sale, or in a promotion ("Store Program Rules") also apply to your participation in that Store Program.
By selecting an affirmative enrollment or acceptance control, or by continuing to use SuperSonic Rewards after these Terms are presented to you, you agree to these Terms. If you do not agree, do not enroll or use SuperSonic Rewards.
Your purchases are transactions with the participating merchant, not with SuperSonic. These Terms do not govern the products or services you purchase from a merchant. Our handling of personal information is described in our Consumer Privacy Policy.
You must be at least 13 years old to create a SuperSonic Rewards account. If you are under 18, you may participate only with permission from a parent or legal guardian. A Store Program may impose a higher minimum age or other eligibility requirements.
Rewards never authorize the purchase of alcohol, tobacco, nicotine products, lottery tickets, or any other age-restricted product. Participating merchants remain responsible for age verification and may exclude age-restricted products from earning or redemption.
Your account is personal and for non-commercial use. You may maintain only one account, may not share or transfer it, and must provide accurate information. Your mobile number may serve as your account identifier. If your number, email address, or other account information changes, update it promptly. We may merge duplicate accounts that reasonably appear to belong to the same person.
Each participating merchant determines its own Store Program Rules, which may include:
Store Program Rules may differ from one merchant to another and may change. Review the rules displayed for the applicable Store Program before relying on an earning rate, redemption value, expiration period, or offer. If a Store Program Rule conflicts with these Terms concerning the merchant-funded benefits, the Store Program Rule controls. These Terms continue to control your use of the SuperSonic Rewards platform and account.
You may earn points or other rewards when you identify your account during an eligible transaction at a participating merchant. Eligibility and the amount earned are determined under that merchant's Store Program Rules. Points may not be added retroactively unless the participating merchant allows it.
A participating merchant may exclude particular products, services, payment methods, or transaction types. Purchases funded with government-assistance, health-benefit, flexible-benefit, prepaid, or similar cards may be excluded where required by applicable law or program rules. Rewards must not change a required posted price, benefit amount, or card-program restriction.
Points or rewards may be reversed or adjusted when a transaction is returned, refunded, voided, canceled, charged back, determined to be ineligible, or associated with fraud or error.
Points and rewards earned through one Store Program are maintained separately from points and rewards offered by unrelated merchants. They may be redeemed only with the merchant that issued them or at affiliated locations expressly identified in the applicable Store Program Rules. They may not be redeemed across unrelated Store Programs merely because both merchants use the SuperSonic Rewards application.
Redemption values, eligible items, minimum balances, increments, and combinations with other offers are set by the participating merchant. The merchant funds and honors its Store Program rewards. Questions about a purchase, product, store offer, or refused redemption should ordinarily be directed to that merchant. Questions about application access or an incorrectly displayed balance may be directed to SuperSonic.
Except where applicable law provides otherwise, points and rewards have no cash value, are not property, are not a deposit or stored-value account, do not accrue interest, and may not be sold, transferred, gifted, exchanged for cash, or used as collateral.
The participating merchant determines whether and when its points or rewards expire. Applicable expiration or inactivity rules should be presented through the application, at enrollment, or in the Store Program Rules.
A participating merchant may change, suspend, or end its Store Program, subject to applicable law and any notice commitment in its Store Program Rules. SuperSonic may change the operation or availability of the shared platform. Where reasonably practical, material changes affecting existing accounts will be communicated through the application, the applicable Store Program, or the contact information associated with your account.
If a participating merchant leaves the platform or ends its Store Program, redemption may become unavailable. Any treatment of unredeemed points or rewards is governed by that merchant's Store Program Rules and applicable law. SuperSonic is not required to fund, replace, or redeem a participating merchant's points or rewards.
SuperSonic and participating merchants may send transactional communications concerning enrollment, account security, digital receipts, balances, redemptions, and material program changes. Marketing text messages are sent only with the consent required by applicable law. You may reply STOP to a marketing text from a particular messaging program, and marketing emails include an unsubscribe method.
Opting out of marketing does not close your SuperSonic Rewards account and does not prevent necessary transactional or security communications. See our SMS & Messaging Terms.
You may close and request deletion of your SuperSonic Rewards account through account settings where available or through our Privacy Requests page. Closing the shared account ends your access to all Store Programs connected to it. Unredeemed points and rewards are forfeited.
Account deletion is subject to transaction, fraud-prevention, security, accounting, and legal-retention requirements described in our Consumer Privacy Policy and Privacy Requests page.
You may not:
SuperSonic or the applicable participating merchant may suspend access, reverse points or redemptions, or close an account or Store Program membership where there is a reasonable belief of fraud, abuse, error, a security risk, or a violation of these Terms or the Store Program Rules.
SuperSonic and participating merchants exchange information as necessary to operate Store Programs, display balances, apply rewards, provide receipts, prevent fraud, support members, and comply with law. Our practices are described in the Consumer Privacy Policy. Where an offer or promotion is funded by a brand, manufacturer, supplier, or other partner, we may report to that funder which stores participated, how the offer was configured, how many times it was redeemed, and how it performed at store level, so that the funder can verify and pay for the program. That reporting identifies the store rather than you: it does not include your name, contact details, loyalty identifier, or payment card information, and information that identifies you is shared only as described in the Consumer Privacy Policy and with any consent applicable law requires.
A participating merchant is an independent business and may process information for its own purposes. Its privacy notice may also apply to your transactions and Store Program participation. Privacy requests concerning SuperSonic may be submitted through our Privacy Requests page. Requests concerning a merchant's independent records may need to be completed by that merchant.
Some Store Programs may require a program-specific notice concerning loyalty benefits, privacy practices, or a financial incentive under applicable law. Where required, that notice will be provided by or on behalf of the participating merchant and will describe the material terms applicable to that Store Program. Where SuperSonic develops an offer or promotion and makes it available through a participating merchant, SuperSonic is responsible for providing any notice that applicable law requires in connection with that offer, including any notice of financial incentive, and for describing its material terms. A merchant-specific notice controls over these general Terms with respect to that merchant's program-specific disclosure.
THE SUPERSONIC REWARDS PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SUPERSONIC DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY MERCHANT WILL CONTINUE TO PARTICIPATE, OR THAT A PARTICULAR POINT, REWARD, OR OFFER WILL REMAIN AVAILABLE.
Participating merchants are independent businesses. They are responsible for their products, services, transactions, Store Program Rules, and merchant-funded rewards. SuperSonic does not make warranties concerning products or services sold by a participating merchant.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPERSONIC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOST REWARDS ARISING FROM THE PLATFORM. IF LIABILITY TO YOU CANNOT BE EXCLUDED, SUPERSONIC'S TOTAL LIABILITY UNDER THESE TERMS WILL NOT EXCEED $100 USD.
Nothing in these Terms excludes a right or remedy that cannot lawfully be excluded.
Please read this section carefully. It affects your legal rights.
If a dispute arises between you and SuperSonic concerning the platform, your SuperSonic account, or these Terms (a "Dispute"), you agree to send an individual written notice to legal@supersonicpos.com before commencing legal action. The notice must describe the Dispute, the basis for your claim, and the resolution you seek.
For 60 business days after receipt, both parties will make good-faith efforts to resolve the Dispute. Applicable statutes of limitation and filing deadlines will be tolled during that period. The parties may agree to mediation or another voluntary dispute-resolution process.
Unless prohibited by applicable law, you and SuperSonic waive trial by jury and agree to resolve Disputes only on an individual basis, not through a class, collective, consolidated, or representative action. A claim must be brought within two years after the events giving rise to it first occur or within the applicable statute of limitations, whichever is shorter.
Nothing prevents either party from bringing an eligible individual claim in small claims court. This section applies only to disputes with SuperSonic; disputes concerning a merchant's products, transactions, or Store Program benefits are matters between you and that merchant.
Governing law and venue. These Terms are governed by Florida law, without regard to conflict-of-law principles. Subject to Section 13 and applicable law, exclusive venue for a Dispute with SuperSonic is in the state or federal courts located in Hillsborough County, Florida.
Changes to these Terms. We may update these Terms. Material changes will be communicated through the platform, by electronic communication, or by posting an updated version. Where required, we will request renewed acceptance. Continued use after the effective date of an update constitutes acceptance to the extent permitted by law.
Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, financing, corporate reorganization, or sale of assets.
Severability. If a provision is unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in effect.
